This TERMS OF — USE AND PRIVACY POLICY is made between MonthlyCards, a company incorporated under the Companies Act, 1956 in India and having its registered office at Sahakar Nagar, Nashik, State of Maharashtra 422001, India, ("App Provider"), and you as a user of the App.
DEFINITIONS "APP or Mobile App or Mobile Application" means a mobile application software or any other name as may be changed from time to time and that is made available to Users to User on the basis of terms and conditions contained herein.
"APP Provider or We" means the name of the Company.
"Use" or "Using" means to access, install, download, copy, or otherwise benefit from using the App subject to terms and conditions contained herein.
"User or You or you" means any person who obtains App for Use.
"Mobile phone" means mobile, tab, and any other handheld device that is capable of Use App.
User is hereby allowed to Use App. User acknowledges and understands that User has the discretion not to use the APP, so in terms User's Use of the APP despite the right and power not to use, it is construed that the User has accepted terms contained herein. The App is only for your Use and it is your responsibility not to share the App downloaded by you to any third party.
You have a right not to supply personally identifiable information. If you intend to Use App it is solely at your own volition, risk, and after reading and confirming it to these terms of use and privacy policy.
We do not store any data in whatsoever manner in terms of your name, your mobile number, the make of your mobile number, your location, or any other information that is personally identifiable to the User.
The Use of App may create certain information patterns which may be used for analytics. Any such information, however, will not reveal the User's identification in whatsoever manner.
All such information is protected by us by way of a manual and/or electronic security system that offers security of reasonable nature.
We do not warrant that the App may serve your purpose and is of Use to you. The advice or information provided on the App will depend on the information that you shared on the App. User understands and acknowledges that we do not warrant that advice or information given by App is complete, exhaustive, and appropriate. We also need to make you aware that although we provide appropriate firewalls and protections, our systems are not hackproof. Data pilferage due to unauthorized hacking, virus attacks, technical issues beyond our control is possible.
We do not warrant or promise that App will function on your Mobile Phone.
THIS APP, AND ALL MATERIALS, PRODUCTS, AND POSTINGS ARE MADE AVAILABLE ON "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY REPRESENTATION OR WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, OR ANY GUARANTEE OR ASSURANCE THAT ALL FEATURES, FUNCTIONS OR OPERATIONS WILL BE AVAILABLE. You understand, acknowledge, and agree that you are assuming the entire risk as to your data, quality, accuracy, performance, timeliness, adequacy, completeness, correctness, authenticity, safety, the security of your own information and data that your voluntarily share on the App.
We may place a text file called a "cookie" in the browser files of your Mobile Phone. The cookie itself does not contain Personal Information although it may enable the App to relate your use of the App to information that you have specifically and knowingly provided to theApp.
You agree to indemnify, defend and hold App Provider, its parents, subsidiaries, affiliates, successors, assigns and licensors, or any of their respective officers, directors, employees, agents, vendors, license, representatives, advertisers, service providers, and suppliers harmless from and against any and all claims, actions, losses, expenses, damages and costs (including reasonable attorneys' fees), resulting from any breach or violation of this Agreement by you, or due to your activities related to the APP.
These terms and conditions is the only agreement between the User and the APP Provider. If any provision of these terms and conditions is held to be illegal, invalid, or unenforceable, this will not affect any other provisions and the terms and conditions will be deemed amended to the extent necessary to make it legal, valid, and enforceable. These terms and conditions and your use of the App is governed by, construed, and enforced in accordance with the laws of India applicable to contracts made, executed, and wholly performed internet, and, for the purposes of any and all legal or equitable actions, you specifically agree and submit to the exclusive jurisdiction and venue of the Courts of Nashik, Maharashtra, India and you will not object to such jurisdiction or venue on the grounds of lack of personal jurisdiction or otherwise.
In case you do not agree to the above-specified condition/term, please do not use or recommend the usage of the app.
